TERMS AND CONDITIONS

1. THE PROMOTER

1.1 The competition is promoted by Pelican Products Pty Ltd ABN: 74 129 367 255, of   2 Forbes Close Knoxfield Victoria 3180, Australia (referred to in these Terms and Conditions as “Pelican” or “the Promoter”).

1.2 All correspondence and enquiries relating to this competition should be directed to Pelican at [email protected]

2. THE COMPETITION

2.1 The competition is known as the Pelican Australia Winter Competition 2026 (the “Competition”).

2.2 The Competition is a competition of skill. The winning entry is selected entirely on merit against the published judging criteria set out in clause 7. The Competition does not involve any element of chance and is not a trade promotion lottery. No permit is required under any Australian state or territory legislation.

2.3 Entry into the Competition is free of charge. No purchase is necessary to enter.

2.4 These Terms and Conditions (“T&Cs”) govern all aspects of the Competition and, together with any other instructions published at the entry page, form the complete rules of entry. By entering the Competition, each entrant agrees to be bound by these T&Cs. Entry constitutes acceptance of these T&Cs.

2.5 These T&Cs are published at https://www.pelican.com/au/en/competition and should be read before entering. Pelican Australia recommends entrants retain a copy for their records.

3. COMPETITION PERIOD

3.1 The Competition opens at 12:00 AM Australian Eastern Standard Time (AEST) on Monday, 14 July 2026 and closes at 11:59 PM AEST on Monday, 4 August 2026 (the “Competition Period”).

3.2 Entries received outside the Competition Period will not be accepted. Pelican accepts no responsibility for late, lost, delayed, or incomplete entries arising from technical or other failures outside Pelican’s reasonable control.

3.3 All times referenced in these T&Cs are Australian Eastern Standard Time (AEST), UTC+10.

 

4. ELIGIBILITY

4.1 Entry is open to Australian residents aged 18 years and over at the time of entry.

4.2 Proof of Australian residency and age may be requested at any time. Pelican reserves the right to disqualify any entry where eligibility cannot be verified.

4.3 The following persons are not eligible to enter:

(a)     employees, directors, officers, or contractors of Pelican Products and its related entities;

(b)     employees, directors, officers, or contractors of Makii and any other agencies engaged in the production, promotion, or administration of the Competition;

(c)     immediate family members (spouse, de facto partner, parent, sibling, or child) of any person described in (a) or (b) above; and

(d)     any person acting on behalf of or as agent for an ineligible person.

4.4 Participation is void where prohibited or restricted by applicable law.

5. HOW TO ENTER

5.1 To enter the Competition, an entrant must, during the Competition Period:

·       (a) visit the official competition entry page at https://www.pelican.com/au/en/competition;

·       (b) complete all required fields in the entry form, including name, email address, and any other information requested;

·       (c) upload a single original photograph ("Entry") that meets all requirements set out in clause 6; and

·       (d) submit the completed entry form.

5.2 Entrants may submit more than one entry. Each entry must be submitted separately via a completed entry form and must meet all requirements in clause 6. Each eligible entry will be assessed independently against the Judging Criteria in clause 7.

5.3 Each entrant is responsible for ensuring their entry is correctly submitted. Pelican accepts no responsibility for entries not received, lost in transmission, or corrupted due to technical issues. Proof of submission does not constitute proof of receipt.

5.4 By submitting an entry, the entrant confirms that all information provided is true, accurate, and complete. False or misleading information may result in disqualification.

5.5 Entry via third parties, automated means, or software-assisted processes is prohibited and will result in disqualification.

6. ENTRY REQUIREMENTS

6.1 To be eligible, each Entry must:

(a)     be a real, original photograph taken by the entrant;

(b)     visibly and prominently feature a Pelican product in active use;

(c)     depict the Pelican product in a genuine Australian winter outdoor environment, including but not limited to rain-soaked trails, coastal storms, snowfields, alpine environments, or equivalent conditions;

(d)     not be AI-generated, computer-generated, or substantially produced by artificial intelligence or image synthesis tools;

(e)     not be a heavily edited composite image that removes or substantially alters the environmental context to misrepresent the conditions depicted;

(f)      be submitted in a digital image file format as specified on the entry page (e.g. JPEG or PNG);

(g)     meet the minimum resolution and file size requirements specified on the entry page;

(h)     not contain material that is defamatory, offensive, obscene, discriminatory, violent, or otherwise inappropriate;

(i)       not infringe any third-party intellectual property rights, including copyright, trade marks, and rights of publicity or privacy;

(j)       not contain any third-party branding, logos, or trade marks without appropriate authorisation; and

(k)     not have been previously published, submitted to another competition, or used commercially without disclosure.

6.2 Staged studio shots and images that fabricate environmental conditions are not in the spirit of the Competition and may be disqualified.

6.3 Where an Entry features an identifiable person other than the entrant, the entrant warrants that they have obtained the informed written consent of that person (or their legal guardian if a minor) to submit, use, and publish the image in connection with the Competition, including in any promotional and marketing materials.

6.4 Pelican reserves the right to request evidence of compliance with clause 6 at any time. Failure to provide satisfactory evidence may result in disqualification.

7. JUDGING

7.1 All eligible entries will be reviewed and judged by a panel of judges appointed by Pelican (“Judges”). The judging panel will include Wayne Pannell, Managing Director, Pelican Australia, in an internal judging review capacity.

7.2 Judging will take place on or around Thursday, 6 August 2026, following the close of the Competition Period.

7.3 The winning entry will be selected against the following equally-weighted criteria (“Judging Criteria”):

Authenticity of Conditions

The image genuinely reflects real winter outdoor conditions. The environment is credible, unmanipulated, and contextually true.

Prominence of Pelican Product

The Pelican product is clearly visible and central to the image, integral to the scene rather than incidental.

Technical Image Quality

The photograph demonstrates competent technical execution including focus, exposure, composition, and resolution.

Alignment with Campaign Theme

The image captures the spirit of “Put It to the Test,” showing a Pelican product in action in demanding real-world conditions.

7.4 The Judges’ decision is final and binding in all respects. No correspondence will be entered into regarding the outcome of judging.

7.5 In the event of a tie, the Judges will determine the winner by applying additional scrutiny to the “Authenticity of Conditions” criterion as the primary tiebreaker.

7.6 Pelican reserves the right to seek an independent verification of the winner’s eligibility and entry authenticity before confirming the outcome.

8. THE PRIZE

8.1 There is one (1) prize available in the Competition, consisting of:

1 x Pelican 1535 Air Carry-On Case, Black with Foam Retail Value: $644.95 inclusive of GST

8.2 The prize will be fulfilled by shipping directly from Pelican Australia to the winner’s nominated Australian delivery address.

8.3 The prize is supplied in brand new condition, is not transferable or exchangeable, and cannot be redeemed for cash or any other alternative. It is not available in conjunction with any other offer, promotion, or discounted pricing, and is subject to the standard product warranty applicable to Pelican products sold in Australia.

8.4 If the prize or any component becomes unavailable for any reason beyond Pelican’s reasonable control, Pelican reserves the right to substitute a prize of equal or greater value, subject to any applicable regulatory requirements.

8.5 The total prize pool for this Competition is $644.95 inclusive of GST.

9. ENTRY INCENTIVE — DISCOUNT CODE

9.1 All entrants who submit a valid, complete entry during the Competition Period will receive a discount code (“Code”) entitling them to a 10% discount on eligible products at https://www.pelican.com/au/en (the “Pelican Website”).

9.2 The Code will be provided to the entrant upon successful submission of their entry form.

9.3 The Code is valid for use on the Pelican Website only, for the duration of the Competition Period (14 July to 4 August 2026) unless otherwise stated at the time of issue. It is for single use only, may not be combined with any other offer, promotion, or discount, is non-transferable, cannot be sold, traded, or shared, has no cash value, and applies to eligible products only. Certain products may be excluded as noted at the time of issue.

9.4 Pelican reserves the right to withdraw or modify the Code in the event of fraud, misuse, system error, or any other factor outside Pelican’s reasonable control.

9.5 Receipt of a Code does not constitute entry confirmation. Entrants should retain their entry submission confirmation for their records.

10. WINNER NOTIFICATION AND ANNOUNCEMENT

10.1 The winner will be notified by email to the address provided at the time of entry, on or around Friday, 7 August 2026.

10.2 The winner must respond to the notification email within five (5) business days of the date the notification is sent, confirming acceptance of the prize and providing a valid Australian delivery address. Failure to respond within this period will constitute forfeiture of the prize, and Pelican reserves the right to select an alternate winner from the remaining eligible entries.

10.3 Pelican is not responsible for unclaimed prizes arising from incorrect contact information provided by an entrant, or from failure of any electronic communication to be received.

10.4 The winner’s name and State or Territory of residence will be published at https://www.pelican.com/au/en/competition on or around 7 August 2026, unless the winner objects in writing within three (3) business days of notification.

10.5 Where required by applicable law, Pelican will publish winner details and comply with any statutory unclaimed prize obligations.

11. INTELLECTUAL PROPERTY AND LICENCE GRANT

11.1 Each entrant warrants that their Entry is their own original work, that they are the sole author and copyright owner of the Entry, and that the Entry does not infringe the intellectual property rights or any other rights of any third party.

11.2 By entering the Competition, each entrant grants Pelican and its related entities, licensees, and successors a non-exclusive, royalty-free, perpetual, worldwide, sub-licensable licence to use, reproduce, modify, adapt, edit, publish, distribute, broadcast, communicate to the public, and otherwise exploit the Entry (including the winning entry and any shortlisted entries, at Pelican’s discretion) in any media, format, or platform for the following purposes:

(a)     administering the Competition;

(b)     promotional, marketing, and advertising activities relating to the Competition; and

(c)     internal and external communications relating to Pelican’s products and brand.

11.3 The licence in clause 11.2 is granted without payment of any fee, royalty, or other compensation to the entrant beyond any prize the entrant may be entitled to receive under these T&Cs.

11.4 Where Pelican exercises the licence under clause 11.2, Pelican will seek to attribute the Entry to the entrant where reasonably practicable, though attribution cannot be guaranteed in all cases.

11.5 The entrant’s moral rights (as defined under the Copyright Act 1968 (Cth)) are acknowledged. By entering, entrants consent to any act or omission by Pelican that would otherwise constitute an infringement of those moral rights.

11.6 Entrants retain ownership of the copyright in their Entry, subject to the licence granted above. Entry into the Competition does not transfer copyright ownership to Pelican.

12. PRIVACY

12.1 Pelican collects personal information from entrants in accordance with its Privacy Policy, available at https://www.pelican.com/au/en/about/privacy-policy (the “Privacy Policy”). The Privacy Policy forms part of these T&Cs.

12.2 Personal information collected in connection with the Competition, including name, email address, delivery address, and photographic Entry, will be used to:

(a)     administer the Competition, including assessing and judging entries;

(b)     notify and verify the identity of the winner;

(c)     fulfil and deliver the prize;

(d)     publish the winner’s name and state in accordance with clause 10.4; and

(e)     send the entrant the discount code described in clause 9.

12.3 By entering, each entrant consents to Pelican using their name, image, and Entry (including photographic content) for promotional and marketing purposes in accordance with the licence granted in clause 11.

12.4 Pelican may disclose entrants’ personal information to third-party service providers engaged to assist with administering the Competition (including the competition platform provider and fulfilment logistics provider), to Makii and other agencies engaged to assist with the Competition, and to any person or entity as required by applicable law or regulation.

12.5 Pelican will handle all personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Entrants may request access to, or correction of, their personal information by contacting Pelican at [email protected].

12.6 Entrants who do not wish to consent to the use of their personal information for promotional purposes as set out in clause 12.3 may opt out by notifying Pelican in writing at the time of entry. Opting out of promotional use will not affect an entrant’s eligibility to enter or win the Competition.

13. CONDUCT AND DISQUALIFICATION

13.1 Pelican reserves the right, at its absolute discretion, to disqualify any entrant or entry at any time, including after the announcement of a winner, if:

(a)     the entry does not meet the requirements in clauses 5 or 6;

(b)     the entrant is not eligible under clause 4;

(c)     the entrant has tampered with, or attempted to tamper with, the entry process or the operation of the Competition;

(d)     the entrant has engaged in unlawful, fraudulent, misleading, or unethical conduct in connection with the Competition;

(e)     the entrant has used automated, robotic, or software-assisted entry mechanisms;

(f)      the Entry infringes any third-party intellectual property or other rights;

(g)     the Entry contains material that is defamatory, offensive, obscene, discriminatory, or otherwise inappropriate; or

(h)     the entrant has failed to comply with any requirement of these T&Cs.

13.2 Where a disqualified entry has already been selected as the winning entry, Pelican reserves the right to select an alternate winner from the remaining eligible entries. Where the prize has already been delivered to a disqualified entrant, Pelican reserves the right to seek return of the prize or its equivalent monetary value.

14. LIMITATION OF LIABILITY

14.1 To the maximum extent permitted by law, Pelican and its related entities, officers, employees, agents, and contractors exclude all liability for:

(a)     any loss, damage, injury, or expense (including indirect, consequential, special, or punitive loss) arising from or in connection with participation in the Competition, acceptance or use of the prize, or any technical failure, malfunction, or interruption affecting the entry process;

(b)     any late, lost, delayed, incomplete, corrupted, or misdirected entries or communications;

(c)     any error, omission, or inaccuracy in entry information;

(d)     any damage to an entrant’s computer, device, or system arising from downloading or otherwise accessing competition materials; and

(e)     any tax liability incurred by the winner in connection with the prize. Each entrant is responsible for meeting their own tax obligations, if any.

14.2 Nothing in these T&Cs limits or excludes any guarantee, right, or remedy conferred on consumers under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) that cannot lawfully be excluded or limited.

14.3 Where Pelican’s liability cannot be excluded by law, that liability is limited to the replacement or supply of an equivalent prize, at Pelican’s election.

14.4 Entrant agrees to indemnify, defend, and hold harmless Pelican and Our Affiliates against any claim, demand, suit, or proceeding made or brought against Pelican by a third party alleging that entrant’s Content, or participation is in breach of this Agreement, infringes or misappropriates such third party’s or other intellectual property rights or violates applicable law.

15. PROMOTER’S RIGHT TO MODIFY, SUSPEND, OR CANCEL

15.1 Pelican reserves the right, at its sole discretion and at any time, to:

(a)     modify these T&Cs, the Competition Period, or any aspect of the Competition, provided that any modification does not materially disadvantage entrants who have already entered;

(b)     extend the Competition Period;

(c)     suspend or cancel the Competition where circumstances outside Pelican’s reasonable control arise, including natural disaster, technical failure, regulatory change, or any act or omission that compromises the integrity of the Competition; and

(d)     substitute the prize with a prize of equal or greater value where required by circumstances outside Pelican’s control.

15.2 Where Pelican exercises any right under clause 15.1, Pelican will endeavour to publish updated information on the Competition entry page at https://www.pelican.com/au/en/competition as soon as reasonably practicable.

16. GENERAL

16.1 The Competition is conducted by Pelican and is in no way sponsored, endorsed, administered by, or associated with Instagram, Facebook, Meta Platforms Inc., or any other social media platform. Any questions, comments, or complaints regarding the Competition should be directed to Pelican and not to any social media platform.

16.2 These T&Cs are governed by the laws of the State of New South Wales, Australia, and each entrant irrevocably submits to the non-exclusive jurisdiction of the courts of New South Wales.

16.3 These T&Cs constitute the entire agreement between the entrant and Pelican in relation to the Competition and supersede all prior representations, warranties, and agreements relating to the same subject matter.

16.4 If any clause or part of a clause in these T&Cs is found to be unenforceable or invalid, that clause or part will be severed and the remainder of these T&Cs will continue in full force and effect.

16.5 Pelican’s failure to enforce any right under these T&Cs at any time does not constitute a waiver of that right.

 

17. COMPLAINTS AND DISPUTES

17.1 If an entrant believes these T&Cs have not been complied with in a material respect, they may submit a written complaint to Pelican at [email protected] within ten (10) business days of the relevant event.

17.2 Pelican will acknowledge the complaint within five (5) business days and seek to resolve it within twenty (20) business days.

17.3 Entrants also have rights under the Competition and Consumer Act 2010 (Cth) and may contact the Australian Competition and Consumer Commission (ACCC) at accc.gov.au or their relevant state fair trading body.

18. STATUTORY COMPLIANCE

18.1 The Competition is conducted in compliance with the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law), the Privacy Act 1988 (Cth), and all applicable state and territory laws.

18.2 As a competition of skill as described in clause 2.2, this Competition does not constitute a trade promotion lottery and no permit or authority is required under the gaming and lotteries legislation of any Australian state or territory.

18.3 The prize value stated in these T&Cs is inclusive of GST, as required by law.

18.4 These T&Cs were published and made accessible no later than the Competition open date of 14 July 2026.
